Copyright and Content Ownership

1: ZERYNTH copyright, contributions and copyright assignment policy.
ZERYNTH – Copyright (C) 2016
1.1 “Kinzica” means the entity Kinzica Ventures, LLC.
1.2 Kinzica owns intellectual property rights to any protectable part of the Service, including but not limited to the design, artwork, functionality, and documentation. You may not copy, modify, or reverse engineer any part of the Service owned by the Company.
1.3 Kinzica is not liable for any damages or losses resulting from the Service transmitting information such as invoices, payments and personal messages over unencrypted networks.
1.4 Kinzica respects the intellectual property of others. It may, in appropriate circumstances and at its discretion, disable and/or terminate the accounts of users who repeatedly infringe others’ rights.
1.5 Kinzica does not pre-screen Content, but Kinzica has the right (but not the obligation) in its sole discretion to refuse or remove any Content that is available via the Service.
1.6 ZERYNTH ® is a registered trademark of Kinzica Ventures, LLC in USA and certain countries, and applies internationally under Madrid Agreement. All Kinzica product names and logos are trademarks or registered trademarks of Kinzica. All other company and product names and logos are trademarks or registered trademarks of their respective owners in certain countries.
2: Copyright Assignment
If you plan to contribute to the ZERYNTH project three cases exists: (i) contribution to the code, (ii) contribution to the examples or projects and (iii) contribution to the documentation, training material, etc..
i) If you plan to contribute code to the ZERYNTH project then there is a requirement you should be aware of: contributing code for inclusion in the ZERYNTH suite requires assigning the copyrights on the contributed code to ZERYNTH.
ZERYNTH suite is also a commercial product and it would not be possible for Kinzica to re-license the code without ownership. Note that the ZERYNTH Virtual Machine is not different or a better product with repect to the GPL version. However, on request, ZERYNTH suite and/or its customisation and/or modules can be released under a different license.
The code will always be available to you under the current licensing terms.
Ownership is required when changing the licensing terms and this happens each time the project goes from development/unstable to stable and back because the addition/removal of the GPL linking exception.
Actually It will be easier for the project adopters to have a single ownership point in case of licensing issues (both GPL or commercial).
ZERYNTH definitely does not want to have to sort out copyright related issues in the future.
Notes about Copyright Assignment: Contributions are welcome even without such copyright assignment, the difference is that the contributed code would not be merged into the suite, it could still made available as contributed code with the contributor(s) copyright notice intact.
Submissions of code with copyright notice should only happen through email, please do not commit code with copyright notices directly on the repository.
When submitting code please state clearly your intention to keep the copyright on your work by adding your own copyright notice within the source code and by clearly mentioning your intentions in the message.
Code contributed without copyright notice will be considered donated.
If in doubt with licensing or copyright issues please do not hesitate to contact ZERYNTH at email@example.com in order to sort out any problem you may have.
(ii) and (iii) Conversely if you plan to contribute to ZERYNTH Examples through projects, examples, comments, etc.. and to the documentation, training material, etc.. all of them will be released under CC BY-NC-SA licence scheme (Attribution-NonCommercial-ShareAlike 4.0 International). If you believe that your work has been copied in a way that constitutes copyright infringement, or your intellectual property rights have been otherwise violated, please provide the following information to the Kinzica’s copyright agent:
- an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright or other intellectual property interest;
- a description of the copyrighted work or other intellectual property that you claim has been infringed;
- a description of where the material that you claim is infringing is located on the site;
- your address, telephone number, and email address;
- a statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
- a statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright or intellectual property owner or are authorized to act on the copyright or intellectual property owner’s behalf.
